VUHOST group entity, the details of which are indicated in the
VUHOST’s Terms of Service,
("VUHOST") provides you web-hosting, domain name registration, and related products
and service.
VUHOST seeks to ensure the highest level of data privacy when offering its variety of
quality
products and services to VUHOST customers and subscribers ("Subscribers")
(collectively, “You”,
or "Users").
At VUHOST, the privacy and security of our Users is of paramount importance.
VUHOST is
committed to protecting the data you share with us.
When this Policy mentions "VUHOST", "we," "us", or "our", it refers to
VUHOST that is
responsible for protection of your personal information in line with this Privacy Policy ("Data
Controller").
This Privacy Policy ("Policy") explains how VUHOST processes information that can be
used to
directly or indirectly identify an individual ("Personal Data") collected on our Site, our services
(“Service”), forums and our mobile applications ("Platform").
All personal data are processed in accordance with the General Data Protection Regulation (EU)
2016/679 (“GDPR”).

VUHOST shall process all Personal Data adhering to the general data processing
principles:
lawfully, fairly and in a transparent manner in relation to the data subject (lawfulness, fairness,
and transparency);
collect and process Personal Data only for specified, explicit and legitimate purposes and not
further processed in a manner that is incompatible with those purposes (purpose limitation);
ensure that Personal Data is adequate, relevant and limited to what is necessary for relation to the
purposes for which they are processed (data minimization);
ensure that Personal Data is accurate and, where necessary, kept up to date (accuracy);
ensure that Personal Data is kept in a form which permits identification of data subjects for no
longer than is necessary for the purposes for which the personal data are processed (storage
limitation);
process Personal Data in a manner that ensures appropriate security of the personal data, including
protection against unauthorized or unlawful processing and against accidental loss, destruction or
damage, using appropriate technical or organizational measures (integrity and confidentiality).
All and any information stored on VUHOST's Platform is treated as strictly
confidential. All
information is stored securely and is accessed by qualified and authorized personnel only.
We use, store, combine and process information, including personal information, about you to
provide, understand, improve, and develop the VUHOST Platform, create and maintain a
trusted and
safer environment and comply with our legal obligations.
To Identify. Personal identification information is collected and processed for the purposes of User
identification as well use of services and domain name registration. Additionally, this information
may be used to provide Users with support, letting them know about upcoming updates or improvements,
providing information regarding changes of any Terms of Use (including changes to this Policy) as
well as other important information.
To Create and Maintain Trusted Environment. We verify or authenticate information or identifications
provided by you (such as ID number, email or phone numbers). We also use collected information to
detect and prevent fraud, spam, abuse, security incidents, and other illegal and harmful
activities.
To Create Aggregated Statistical Data, to Carry out Market Research and Analysis necessary for
running out our business, to improve our services we use aggregated and/or inferred non-personal
information enabling us to evaluate our customers’ needs, sales and other trends of our
activities.
To Stay Connected. We use information about data usage, devices, operating systems to diagnose
problems with our servers, to administer our Platform, adopt decision when to retire SDK's/OS
versions, to identify characteristics of major users so that we may optimize our applications and
services and make your browsing and purchasing experience more enjoyable.
To Customize Marketing. To provide more customized offers to our Users, we may conduct data analysis
based on information you provide to us, your interactions with the VUHOST Platform
and its Users.
To Send Service and Billing Messages. VUHOST may also contact you with important
information
regarding our Services, or your use thereof. For example, we may send you a notice (through any of
the communication channels available to us) if a certain Service is temporarily suspended for
maintenance; reply to your support ticket or e-mail; send you reminders or warnings regarding
upcoming or late payments for your current or upcoming subscriptions; forward abuse complaints
regarding your hosting plan; or notify you of material changes in our Services. Such kind of
communication is essential, for this reason, no opt-out possibilities are given to avoid receiving
such Service and Billing Messages unless you are no longer a VUHOST User (which can
be done by
deactivating your Account).
To Register Domain. In certain jurisdictions or pursuant to the rules of the ICANN or certain
registries, domain name registration information has to be made available and accessible to the
public through a "WHOIS" search. The WHOIS database is a publicly accessible database that lists the
domain name registration information for a particular domain name, the name server(s) to which the
domain name points, and the domain name's creation and expiration date. The domain name registration
information you provide is stored by VUHOST and is made available to the public
through WHOIS
searches. VUHOST may deposit your domain name registration information with a
third-party escrow
provider to comply with ICANN requirements. At times, Users may receive solicitations that result
from searches of the publicly available WHOIS database by other companies or individuals. Any such
solicitations or e-mail communications do not come from VUHOST and
VUHOST is not responsible
for the use of WHOIS information by third parties. VUHOST acts only on the basis of
ICANN rules
and requirements.
To contact you. In order to notify you regarding your Account, to troubleshoot problems with your
Account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys
or questionnaires, to send updates about our company, or as otherwise necessary to contact you to
enforce our User Agreement, applicable national laws, and any agreement we may have with you. For
these purposes, we may contact you via email, telephone, text messages, and portal.
To get feedback. We may contact you via email to invite you to review any services and/or products
you received from us in order to collect your feedback and improve our services. We might use an
external company, to collect your feedback which means that we will share your name, email address
and reference number for this purpose.
To provide, operate and improve the Services.
To enhance data security and to prevent fraud.
To comply with applicable laws and regulations.
Products purchased from VUHOST may be refunded only if canceled within 30 days of
the date of the
transaction.
Note: Due to their nature, cryptocurrencies, tokens and digital assets are generally irreversible
and their exchange rates are highly volatile and transitory. We can not be responsible for any risk
including but not limited to exchange rate risk and market risk. Products purchased using
cryptocurrencies, tokens or digital assets will not be refunded.
“Date of the transaction,” for the purpose of this Refund Policy, means the date of purchase of any
product or service, which includes the date any renewal is processed by VUHOST in
accordance with
the terms and conditions of the applicable product or service agreement (Terms of Use). You may
cancel a product at any time, but a refund will only be issued if cancellation is requested within
the refund timeframe specified for the applicable product, if available at all. Note: Some products
have different policies or requirements for a refund associated with them, including some products
that are not eligible for a refund under any circumstance. Please see below for refund terms
applicable to such products:

Any products or services that were suspended, canceled, or terminated due to the abusive usage of
the products, services, or any other violation of the Terms and Conditions are not eligible for a
refund.
The purpose of the refund is for customers to try and understand whether the services provided by
VUHOST suit their needs. In any way, VUHOST will not tolerate
abusive usage of refunds (i.e.,
refunding the same services multiple times and (or) repetitively purchasing and asking for a refund
for services purchased in bulk, etc.). VUHOST remains a right to unilaterally
decline the request
for a refund if any of the signs related to the abusage of the refunds occur.
Over-funded balance can be refunded within 30 days of the payment that resulted in the over-funding. In special cases, other payments can be refunded instead of the original payment if the 30-day time-frame can be applied to those payments.
If at any time, we record a decline, chargeback, reversal, payment dispute, risk of payment fraud or
other rejection of a charge of any payable fees on your VUHOST account
(“Chargeback”), this will
be considered as a breach of your payment obligations hereunder, therefore you agree that
VUHOST
may pursue all available lawful remedies in order to obtain payment, including but not limited to,
immediate termination, without notice to you, of your VUHOST account and any domain
names or
VUHOST services registered or renewed on your behalf (“Services”). In addition, this
will also
result in disabling the option to checkout with a credit card for your VUHOST
account to limit
the risk of payment fraud.
In the event a Chargeback is performed, your VUHOST account may be blocked without
the option to
re-purchase or re-use it, and any data contained in such a VUHOST account, including
any certain
content, features, or capacity of your VUHOST account may be subject to cancellation
and loss of
data.
Your use of the VUHOST Services and the ability to checkout using credit card will
not resume
until you:
verify the payment method used for the disputed transaction, either by providing:
proof of the payment; or
a simple censored photo of the credit card, with uncovered first 6 (six) and last 4 (four) digits.
pay any applicable fees in full, including any fees and expenses incurred by VUHOST
and/or any
third party services for each Chargeback received (including fees for VUHOST
Services provided
prior to the Chargeback, handling and processing charges and fees incurred by the payment
processor).
Cases related to criminal fraud chargebacks or obvious payment fraud (i.e. cases where compromised
credit card details were used to make purchases) will result in permanent service termination
without any option to recover.
If you have any questions or concerns regarding a payment made to VUHOST, we
encourage you to
first contact our Customer Support team before filing a Chargeback or reversal of payment, in order
to prevent the VUHOST Services from being canceled and your VUHOST
account being blocked, and
to avoid the filing of an unwarranted or erroneous Chargeback, which may result in your being liable
for its applicable fees, in addition to re-payment of all the fees applicable to the
VUHOST
Services purchased (and charged-back) by you.
We reserve our right to dispute any Chargeback received, including by providing the relevant credit
card company or financial institution with any information and documentation proving that the User
responsible for such Chargeback did in fact authorize the transaction and make use of the Services
rendered thereafter.
Migration of Servers. You acknowledge and agree that as a normal course of business, it may be
necessary for us to migrate our servers. As a result, even if you have a dedicated IP, you may be
assigned a different IP number. We do not warrant that you will be able to consistently maintain
your given IP numbers.
Termination of Services. You acknowledge and agree that upon expiration or termination of your
Services, you must discontinue use of the Services and relinquish use of the IP addresses and server
names assigned to you in connection with Services, including pointing the domain name system (“DNS”)
for your domain name(s) away from our servers. Prior to termination of the Services, you are
responsible for moving your website or server content off our servers. We will not transfer or FTP
your website or server content to another provider. If you fail to move your website or server
content off our servers prior to cancellation, then all such content will be deleted and we will not
be able to provide a copy of such content.
Free Products Credits. Upon termination of the Services, all free products provided as part of the
Services will be cancelled or revoked.
Storage and Plan Limits. All Hosting plans, including the unlimited plans, are subject to the
following (but not limited) limitations: Inode count, Database size, CPU power, amount of RAM, Entry
Processes, Active Processes. In the event plan limitations are exceeded, you may need to reduce the
number of files or database size, your site may slow down or not be served until resources are
released or more resources are added, and your site may be temporarily or permanently suspended, in
our sole discretion. More resources may be added at any time by upgrading the plan. VUHOST
reserves the right to change the plan limits at any time and such changes shall be posted online at
VUHOST web sites.
You acknowledge and agree that inbound UDP is not supported in shared hosting environments.
Website/Server Content. Your website may not include any of the following content: (1) image hosting
scripts that allow an anonymous user to upload an image for display on another website (similar to
Photobucket or Tinypic); (2) banner ad services for display on other websites or devices (commercial
banner ad rotation); (3) file dump/mirror scripts that allow an anonymous user to upload a file for
other to download (similar to rapidshare); (4) commercial audio streaming (more than one or two
streams); (5) push button mail scripts that allow the user to specify recipient email addresses; (6)
anonymous or bulk SMS gateways; (7) backups of content from another computer or website; (8)
Bittorrent trackers; or (9) any script that causes a degradation in the performance of our server or
network environment.
Unlimited Disk Space/Bandwidth/Website Plans. This means that we do not charge according to the
amount of disk space or bandwidth you use, but we do require all customers to be fully compliant
with our Terms and Conditions and to only utilize disk space and bandwidth in the normal operation
of a personal or small business website. However, in the event your service usage or content
presents a risk to the stability, performance or uptime of our servers, data storage, networking or
other infrastructure, you may be required to reduce usage, upgrade your current Plan or we may take
action to restrict the resources your website is utilizing.
We offer a Service uptime guarantee of 99.9% (“Service Uptime Guarantee”) of available time per month. If we fail to maintain this Service Uptime Guarantee in a particular month (as solely determined by us), you may contact us and request a credit of 5% of your monthly hosting fee for that month. The credit may be used only for the purchase of further products and services from us, and is exclusive of any applicable taxes. The Service Uptime Guarantee does not apply to service interruptions caused by: (1) periodic scheduled maintenance or repairs we may undertake from time to time; (2) interruptions caused by you from custom scripting, coding or the installation of third-party applications; (3) outages that do not affect the appearance of your website but merely affect access to your website such as FTP and email; (4) causes beyond our control or that are not reasonably foreseeable, including, but not limited to, DDOS attacks and IP blacklists; and (5) outages related to the reliability of certain programming environments; (6) interference with internet connectivity at the customer's ISP; (7) interference with internet connectivity that occurs on one of the routes which is the connectivity path from the customer to our server; (8) browser caching or DNS issues; (9) your fault or negligence; (10) interference caused by other parties; (11) violation of our Terms and Conditions.
Claims for the failure of the guarantee above can be claimed within a maximum of 30 days after the interruption occurred.
